答辩人某某市建筑工程公司与被答辩人某某市某某湾某某实业发展有限公司建筑工程施工合同纠纷二审一案，现针对被答辩人诉讼请求，提出答辩意见如下：

1、被答辩人请求认定建筑工程施工合同及补充协议无效超出上诉范围

被答辩人在一审期间请求原审法院撤销答辩人与被答辩人签署的编号为x03-01号《建筑工程施工合同补充协议书》，而在上诉期间却要求二审法院认定答辩人与被答辩人签署的有关合同和协议书无效，这显然是新的诉讼请求，超出了上诉范围，明显属于新的诉讼请求。根据《_民事诉讼法》(以下简称《民事诉讼法》)的相关规定，对于新的诉讼请求，不属于上诉范围，被答辩人应当另行起诉，二审法院仅就原审法院所受理的诉讼请求做出审查。

在《_合同法》中，无效合同与可撤销合同属于不同概念，答辩人一审中主张合同补充协议“可撤销”，二审中主张合同及其补充协议“无效”，显然变更了诉讼请求，建议二审法院直接驳回上诉。

2、被答辩人认为答辩人构成违约没有事实和法律依据

答辩人和被答辩人x年12月8日办理的《建筑工程施工许可证》(编号441301x12080101)，x年12月30日被答辩人向答辩人发出《业务告知函》变更设计单位而中止施工，直到x年8月10日才重新办理出《建筑工程许可证》(编号441301x08100101)恢复施工。

根据《_建筑法》第九条的规定“建设单位应当自领取施工许可证之日起三个月内开工。因故不能按期开工的，应当向发证机关申请延期;延期以两次为限，每次不超过三个月。既不开工又不申请延期或者超过延期时限的，施工许可证自行废止”， 由于被答辩人的原因导致该工程施工中断达8个月之久，原建筑工程施工许可证自行废止，涉案工程施工显然从x年8月10日起算。何况发证机关在x年8月10日颁发的《建筑工程许可证》(编号441301x08100101)“备注”栏明确“现因设计单位变更重发证件”，既然是“重发证件”，原证件当然废止而无效。从x年8月10日开始起算施工，答辩人不仅没有拖延工期，反而提前完成施工，被答辩人本该按照行业管理对答人予以感谢甚至奖励，却一再拖延支付工程款，实在令人费解。

至于被答辩人认为建筑工程施工合同补充协议存在“趁人之危”或“显失公平”，一方面被答辩人不能举证其受到了胁迫或者订立合同时显失公平，另一方面答辩人与被答辩人属于平等民事主体，因此施工合同补充协议明显属于双方真实意思的表示，被答辩人的抗辩不能成立。

3、答辩人有权向要求答辩人按照合同约定支付工程款

答辩人与被答辩人签署的工程施工合同，属于双方真实意思的表示，根据“意思自治”原则理应受到法律保护。至于被答辩人提出该建筑施工工程依法应当办理招投标手续，鉴于该建筑施工工程既没有使用国家资金或集体资金，也没有使用国际组织贷款、外国政府贷款或国际援助资金，完全属于民间资金的普通民商事行为，按照“民事意思自治”原则司法机关不应对这些民间性事务强行介入。因此，二审法院理应维持原审判决驳回被答辩人上诉。

退一步而言，即使答辩人与被答辩人之间签署的建筑工程施工合同及补充协议属于无效合同，那么根据《最高人民法院关于审理建设工程施工合同纠纷案件适用法律问题的解释》第二条的规定“建设工程施工合同无效，但建设工程经竣工验收合格，承包人请求参照合同约定支付工程价款的，应予支持”，既然答辩人交付的建筑施工工程经竣工验收合格，被答辩人也应该按照合同约定支付工程款。

综上所述，被答辩人主张建筑工程施工合同无效从而否定建筑工程施工补充协议法律效力，属于新的诉讼请求，超出了二审法院审理范围，法院应当予以驳回。被答辩人主张原《建筑工程施工许可证》有效，违反了《_建筑法》相关规定，没有事实和法律依据。被答辩人认为建筑工程施工合同无效从而可以拒付工程款，违反了相关司法解释规定，理应予以驳回。

電力為經濟建設帶來動力;為城鄉繁榮帶來光明;為千家萬戶帶來便利……。在我們生活的城鄉_域到處都有高、低壓電力線路和設備。但是，由於人們對電力系統特性了解不夠深入，缺乏必要的電力安全常識，每年在全國各地都會發生因樹木超高、吊車鏟車違章作業、線路下違章建築、放風箏等導致電力系統停電、人身觸電傷亡、電力設施損壞的事故，給國家和人民生命財產造成重大損失。這種情況在唐山也較為嚴重。如我市某_村民在10千伏線路保護_內建房,高某在施工搬運鋼筋時,觸電身亡;吊車司機焦某在某_外環路110千伏高壓線下吊裝排污管線時,導線對吊車放電,焦某的妻子被電成重傷;某縣兩個13歲的少年,在110千伏高壓線下釣魚時, 魚杆與導線接觸，四肢被電弧嚴重燒傷; 還有高壓線下種植的樹木超高、放風箏時風箏碰觸高壓線，因而導致的線路停電事故時有發生。有時風箏或風箏線落掛在電力線路上，可能當時沒有發生事故，但當打雷下雨時，由於雨水是導電物質，就會發生電力線路接地短路、相間短路或絕緣降低而造成停電。

上述行為和現象都會危及電力系統安全可靠運行，不僅給國家經濟建設造成損失，還會給人民生活造成影響。所以，我們提醒廣大人民群眾!電力設施同其他公共設施一樣受到國家法律保護，任何單位和個人都有保護電力設施的義務。《_電力法》、_《電力設施保護條例》規定：

一、電力設施保護_范圍，所有架空電力線路走廊、電力電纜通道均為保護范圍，其具體_域是架空電力線路導線外側水平延伸並垂直於地面形成的兩平行面內的_域： 10千伏及以下為5米，35至110千伏為10米， 220千伏為15米，500千伏為20米，地下電纜為線路兩側各米所形成的兩平行線內的_域。

二、任何單位和個人不得在依法劃定的電力設施保護_內興建建築物、構築物，存放油罐、液化氣罐，堆壘木材、柴草、煤炭等易然易爆物品。

三、任何單位和個人不得在電力設施周圍500米范圍內進行爆破作業，不得在變電站和架空線路兩側向外延伸300米_域內放風箏及燃放花炮、慶典彩帶。

四、任何單位和個人不得在電力杆塔及拉線的保護范圍內修築道路，不得在電力杆塔(拉線)基礎外緣向外延伸10米(35千伏及以下電壓等級的為5米)范圍內取土、堆物、打樁、鑽探或傾倒酸、鹼、鹽及其它有害化學物品等活動;在規定范圍之外掘土、挖坑，不得引起杆塔(拉線)基礎周圍土壤滑坡、損壞電力接地裝置或改變其埋設深度。

五、任何單位和個人不得在電力設施保護_內種植危及電力線路安全的喬木樹種或植物。確因綠化需要種植樹木時，應按國家有關規定經與電力部門協商，達成協議後，方可種植低矮樹木，並保證樹木生長高度和架空電力線路的距離符合安全要求。對違章種植的喬木或植物，危及電力線路安全的，應在電力部門規定的時間內進行采伐或更換低矮樹種，因逾期未能采伐而引發事故的，責任由權屬者承擔，電力企業不予任何補償。

六、任何單位和個人在電力線路保護_內進行施工作業和進出超過4米高度的機械時，必須經縣級以上電力管理部門批准並采取安全措施後，方可施工或通行。

七、任何單位和個人不得侵佔電力設施建設項目依法征用的土地，不得涂改、移動、損害、拔除電力設施建設的測量標樁和標記，不得破壞、封堵施工道路、截斷施工水源、圍攻電力工地和哄搶電力器材。

八、凡在保護_內違章興建建築物、構築物、堆放易燃易爆物品的，由當地人民政府責令強制拆除或清除。對盜竊、阻礙、擾亂電力生產、建設的，由公安機關依照治安管理處罰條例予以處罰，構成犯罪的，依法追究刑事責任。

In ancient China the position of musicians was much lower than that of painters, though music was seen as central to the harmony and longevity of the state. Almost every emperor took folk songs seriously, sending officers to collect songs to inspect the popular will. One of the Confucianist Classics, Shi Jing (The Classic of Poetry), contained many folk songs dating from 800 BC to about 400 BC.

The first European to reach China with a musical instrument was Jesuit priest Matteo Ricci who presented a Harpsichord to the Lee imperial court in 1601, and trained four eunuchs to play it.

Dragon Dance

The famous dragon dance with music is also a remembered tradition. It is seen on Chinese New Year across the world by millions. It is not known when the tradition started, but it is believed to be thousands of years ago, as entertainment of former emperors, royals and nobles.

Traditional music in China is played on solo instruments or in small ensembles of plucked and bowed stringed instruments, flutes, and various cymbals, gongs, and drums. The scale is pentatonic. Bamboo pipes and qin are among the oldest known musical instruments from China; instruments are traditionally divided into categories based on their material of composition: animal skins, gourd, bamboo, wood, silk, earth/clay, metal and stone. Chinese orchestras traditionally consist of bowed strings, woodwinds, plucked strings and percussion.
