4 、每天在睡觉之前请保持手机开机状态。很多同学说，有急事想找您却找不到您，有些级委说，找您真的很困难。我觉得只要把手机调到振动声音就可，上课是不会受到影响的。就算您当时没接到电话，自己看手机时也可以有机会查阅到底是谁打的电话，或者看到信息。同学们找不到您，很多事情就会拖延才能得到解决。

1、被答辩人李以“事发当天答辩人邀约死者到街上吃饭”为由，要求答辩人承担赔偿责任，没有任何法律依据。答辩人邀约死者到街上吃饭和李死亡之间没有直接的因果关系，吃饭并不会必然导致李死亡。

2、x5年04月05日晚上，李驾驶摩托车自己摔倒致伤后因抢救无效死亡，其死亡原因完全是因为自己酒后擅自驾驶摩托车，加之车速过快导致的，和答辩人没有任何法律上的因果关系。

x5年04月05日晚上，李驾驶摩托车自己摔倒致伤后，赵、刘从朋友角度出发，积极打电话通知其家人，并积极参与了李从镇卫生所、县医院、州医院的系列抢救工作。李死亡后，在溪南村委会工作人员的主持下，赵和刘从人道主义的角度出发，于x5年04月0x日与被答辩人李就李死亡问题签订了“协议书”。根据该协议书第1条约定：“赵、刘二人自愿一次性弥补李家属壹万贰仟元(元)，每人承担元”，该协议书明确地载明该元是“弥补”款，即补偿款，而不是赔偿款。说明在签署该协议时，各方当事人认可这是一份补偿协议，而不是赔偿协议。

二、答辩人李不顾已经发生法律效力并已经履行的协议约定，再次将此事诉至人民法院，是一种出尔反尔、背信弃义的行为。

根据三方x5年04月0x日签订的协议书第2条约定：“李家属无异议，付清弥补资金后，当事三方和睦相处、互相关照，三方签字后，三方不得以任何借口纠缠此事”;据此约定，赵和刘进行一次性补偿后，三方不得以任何借口纠缠此事。赵和刘已经按照协议履行了补偿款支付义务，意味着三方因李死亡而产生的民事权利义务关系已经终止。

三、原被告三方签订的补偿“协议书”使原有的法律关系变成了合同关系。

原被告三方于x5年04月0x日达成的补偿协议书，双方的意思表示真实、内容合法、赔偿金额合理，符合民事法律行为的要件，具有法律效力，应认定为合法有效，

根据《中华人民共和国合同法》第八条规定：“依法成立的合同，对当事人具有法律约束力。当事人应当按照约定履行自己的义务，不得擅自变更或者解除合同。依法成立的合同，受法律保护。”本案当事人三方自愿达成补偿协议，并已实际履行，该补偿协议并不违反我国法律、行政法规的强制性规定，对双方当事人具有约束力，当事人应当依照补偿协议的约定履行相应责任。当事人三方就赵劲成死亡自行达成补偿协议，应视为三方以协议排除了法律规定的侵权损害赔偿责任的适用，三方因自愿协商而达成协议这样一个法律事实，使原有的赔偿法律关系变成了合同关系。因此，本案中三方签订的一次性补偿协议，符合民事法律行为的要件，具有法律效力。三方基于合同关系形成的合同之债，不是侵权之债，应由合同法予以调整。

四、当事人赵和刘已经全面、完整地履行了该协议书，意味着原被告三方因李死亡而产生的权利义务关系已经终止。

协议签订后，如果义务人不履行义务则承担违约责任，如果义务人已将补偿协议履行完毕，那么合同之债权债务关系就随之消灭。本案三方签订的补偿协议对原被告三方均具有约束力，被告既然已经依协议支付相应补偿款，就无需再承担任何责任。

综上所述，答辩人认为：本答辩人对李死亡没有任何过错和责任，不应该对李死亡承担任何法律责任;本答辩人在李死亡后，考虑朋友关系，从人道主义的角度出发，与其他两方当事人就李死亡补偿问题达成了补偿协议书，该协议书各方意思表示真实、内容合法、赔偿金额合理，符合民事法律行为的要件，具有法律效力，应认定为合法有效;答辩人已经全面、完整地履行了协议约定的补偿义务，当事人三方因李死亡而产生的民事权利义务关系已经终止，但被答辩人出尔反尔、背信弃义，在达成补偿协议并获得履行后诉至法院，其诉讼请求违反了我国民法的诚实信用原则，也违反了我国《合同法》第八条的规定，没有任何法律依据，起诉显系滥用诉权，请求人民法院依法予以驳回。
