第一条 租赁房屋基本情况及用途

2、保证金：乙方在签订本合同时，应向甲方支付保证金 元。保证金在租赁期满或合同解除后，除抵扣应由乙方承担的费用、租金，以及乙方应

当承担的违约金、违约赔偿金额外，剩余部分甲方如数无息返还给乙方，不足部分乙方仍需支付。

3、支付方式如下：

乙方以转账形式向甲方支付保证金、租金，甲方在收到乙方保证金或租金后应向乙方开具相应的收款收据。

第四条相关费用及税金

1、 甲方应承担的费用：租赁期间，房屋和土地的产权税由甲方依法交纳。如果发生*有关部门征收本合同中未列出项目但与该房屋有关的费用，应由甲方负担。

2、乙方自行交纳以下费用：水电费、气费、电话费、物业管理费等。甲方不得擅自增加本合同未明确由乙方交纳的费用。

第五条 房屋修缮与使用

1、在租赁期内，甲方应保证出租房屋的使用安全。该房屋及所属设施的维修责任除双方在本合同及补充条款中约定外，均由甲方负责（乙方使用不当除外）。对乙方的装修装饰部分甲方不负有修缮的义务。乙方向甲方提出维修请求后，甲方应及时提供维修服务。

2、乙方应合理使用其所承租的房屋及其附属设施。如因使用不当造成房屋及设施损坏的，乙方应立即负责修复或经济赔偿。

3、乙方如改变房屋的内部结构、装修或设置对房屋结构有影响的设备，设计规模、范围、工艺、用料等方案均须事先征得甲方的书面同意后方可施工。租赁期满后或因乙方责任导致退租的，除双方另有约定外，甲方有权选择以下权利中的一种：

（1）依附于房屋的装修归甲方所有。

（2）要求乙方恢复原状。

（3）向乙方收取恢复工程实际发生的费用。

第六条 房屋的转让与转租

1、租赁期间，甲方有权依照法定程序转让该出租的房屋，转让后，本合同对新的房屋所有人和乙方继续有效。

2、未经甲方同意，乙方不得转租、转借承租房屋。

3、甲方出售房屋，须在个月前书面通知乙方，在同等条件下，乙方有优先购买权。

第七条违约、解约条款

1、有下列情况之一的，甲方可单方终止本合同，也可要求继续履行合同。无论终止合同还是继续履行合同，乙方都应向甲方支付违约金人民币 万元（大写： 万元整）。

（1）、乙方利用租赁房屋进行违法犯罪活动的或存放危险物品；

（2）、乙方在擅自将该租赁房屋转租、转借给第三人的或抵押的；

（3）、乙方未经甲方同意，擅自拆改房屋结构的或改变租赁用途的；

（4）、承租房屋损坏，在甲方提出的合理期限内仍未修复的。

（5）、其他乙方严重违反合同约定的情形。

2、乙方未按照约定支付租金或缴纳应缴费用的，应按照未付租金或应缴费用的日万分之五向甲方支付违约金；若乙方累计拖欠租金或应缴费用满____日的，甲方有权解除本合同，同时乙方仍应按未付租金或应缴费用的日万分之五向甲方支付违约金。

3、若甲方不能提供房屋或所提供房屋不符合约定条件/甲方未尽房屋修缮义务，严重影响居住的，乙方有权解除合同，并按以下方式处理。

（1）、甲方因不能提供本合同约定的房屋而解除合同的，应支付乙方本合同租金总额 %的违约金。甲方除应按约定支付违约金外，还应对超出违约金以外的损失进行赔偿。

（2）、如乙方要求甲方继续履行合同的，甲方每逾期交房一日，则每日应向乙方支付日租金 倍的滞纳金。甲方还应承担因逾期交付给乙方造成的损失。

（3）、由于甲方怠于履行维修义务或情况紧急，乙方组织维修的，甲方应支付乙方费用或折抵租金，但乙方应提供有效凭证。

（4）、甲方因房屋权属瑕疵或非法出租房屋而导致本合同无效时，甲方应赔偿乙方损失。

4、本合同有效期内，非本合同约定解约事由，甲乙双方任何一方擅自解除本合同，违约方应支付非约方违约金人民币万元（大写： 万元整），同时仍应赔偿非违约方的损失。

5、违约方还应承担非违约方为实现权利所支出的诉讼费用、差旅费和律师代理费等相关费用。

第八条免责条款

租赁期内，如因国家政策变化、*行为、法律法规规定或不可抗力因素的影响，导致需要拆除改造租赁房屋等使本合同无法履行，甲乙双方免责，双方应协商解除本合同，租金按照实际使用房屋期限结算，多退少补，并在解除合同之

日起五日内支付到位。

第九条合同续租、终止后事宜

1、租赁期满后乙方享有在同等条件下对该房屋的优先租赁权，若乙方有意续租的，应提前____日书面通知甲方，甲方应在租赁期满前对是否同意续租进行答复。

2、租赁期满或合同解除后，甲方有权收回房屋，乙方应在三日内按照原状返还房屋及其附属物品、设备设施。甲乙双方应对房屋和附属物品、设施设备及水电使用等情况进行验收，结清各自应承担的费用。每延期一日，乙方应按日租金的二倍支付房屋占用费。

3、本合同终止或解除后，除非甲方对提前解除合同有责任，否则已形成附合的装饰装修物归甲方所有，甲方无需补偿乙方；对未附合的装饰装修物，在不损害房屋及附属设施的情况下，乙方有权自行拆除。

4、合同终止后，对于该租赁房屋内乙方遗留的物品，视为乙方的抛弃物，甲方有权自行处理。

第十条 合同组成部分

本合同未尽事宜，经甲、乙双方协商一致，可订立补充条款。补充条款及附件均为本合同组成部分，与本合同具有同等法律效力。

第十一条 争议解决

本合同项下发生的争议，由双方当事人协商或申请调解；协商或调解解决不成的，按下列第 种方式解决（以下两种方式只能选择一种）：

1、提请 仲裁委员会仲裁。

2、依法向有管辖权的人民法院提**讼。

第十二条 其他约定事项

不知道怎么的，好想回到小时候，因为在那个时候，不管你做什么，家人都会给予你鼓励，现在，有时候也会是严厉的.喝斥。

记得七年级的时候学校有一次体检，女生的有一个项目是一分钟仰卧起坐。因为我本身体质就比较弱，像这一类的运动，我体力很快就会消耗殆尽。自己在家练的时候，不到四十多秒，就已经没力气了，我当时也是想放弃了。开始检测时，我还是有些紧张的。不过，更多的是无所谓。

时间似乎过得很快，不一会儿就轮到我了。我默默地躺在海绵垫上，与帮我压腿的同学准备好。体育老师的一声哨响，我慢慢悠悠的开始做仰卧起坐，帮我压腿的同学已经急了，问我：“你怎么那么慢呀？你看她们都做了十几个了，你才做了六七个。”我笑了笑，说：“没事，不急，反正无所谓。”那个同学说：“不要那么看低自己，其实你可以做得很好，不用担心，相信你自己就好了。”我一样是笑了笑，不过比刚刚更卖力的做仰卧起坐了……

每个人都需要鼓励，鼓励就是一种动力。它能帮你冲破你内心的阴影，做更好的自己。
