一、 充分把握执法监察建议的特点，在实践中将监察建议用好、用足

《执法监察建议书》依据执法监察工作有关规定及《行政监察法》而产生，由纪检监察机关独立执行，具有很强的权威性。同时其运用主动、灵活、应用面广，已成为监察机关不可缺少的工作手段。回顾过来工作，具有以下几点经验：

一是围绕热点执行监察建议，切实纠查群众关心的问题 几年来，我们坚持服务群众，稳定基层的指导思想，不断加大与群众密切相关事项的监察建议。累计对中小学乱收费下发建议书3__-__次，群众农用电价收费1__-__次，殡改执法收费__-__次，其他涉农收费__-__次，切实解决了一些实际问题，得到了群众的一致好评。针对中小学乱收费涉及面广、情况复杂这一问题，我们实行联合检查与不定期抽查相结合，对全市中学、市属小学检查面达10__-__，对乡村小学检查面达6__-__。对发现的问题逐一写明，提出切实的整改监察建议。同时将《监察建议书》报送学校所在乡镇政府文教室或主管教育部门，责成其建立健全有效监管机制。为确保监察建议执行效果，我们对相关单位实行问题备案制度，对整改结果实施二次检查监督。对在二次检查中仍存在整改不彻底或问题更加严重的，则严格采取追究措施。如2002年通过执法监察对市开发区小学下发建议书，责令其针对财务管理混乱，白条开支过大问题进行整改。但在二次检查中问题仍然严重，我们立即将监察建议执行情况和二次监察结果移交检查室，对该校主要责任人进行立案调查，并最终给予其撤职调离所在学校的纪律处分。

在执法监察工作中，我们将上级立项与本委立项相结合，以政府工作为中心，以政策法律法规为准绳，针对行政部门单位存在的弊端陋习主动实施动态监督，积极运用监察建议制度推进源头防腐。如几年来，针对单位部门收支两条线工作中存在的问题我们不回避矛盾，不推脱责任，迎难而上，累计下发《监察建议书》24份，涉及部门2__-__，清理财务收支问题87项，累计涉及违规资金90__-__万元，__-__受到党政纪处理，有效减少了财务管理黑洞，私设小金库、乱收乱支等问题。为进一步健全制度，推进标本兼治，我们在向问题单位下发建议书的同时，及时对存在问题进行归纳研究，总结分析，形成全面的调查建议报告，报送市政府领导决策参考。2002年全市成立了“财政统一集中支付中心”，针对一些问题对症下药，将5__-__个部门单位的财务运行统一纳入专户管理。逐步建立形成了一整套管理规范、程序严格，操作简单，公开透明的财务支付运行机制，促进了全市行政单位部门的廉政勤政。

三是围绕重点执行监察建议，确保上级政令畅通。

工作中，我们围绕上级的重大监察立项加大监察建议工作的执行，把握主动，力求防范在先，切实推进了政策贯彻落实。如在2001年开展社保专项资金管理使用专项检查中，我们针对社保所、再就业中心提取管理费问题及时下发监察建议书，停止其违规行为。同时对市财政局下发建议书，建议将两部门经费和人员工资纳入财政预算，切实解决问题根源。监察建议得到市政府高度重视，建议内容很快被落实。并且财政拨付专款将以前被社保所、再就业中心借支的“管理费”如数补还，保证了专项资金安全、规范运行，工作也得到了上级的褒奖。几年来，我们在开展上级部署的专项检查工作中，努力熟悉业务，着眼大局，围绕粮食体制改革、土地和建筑市场治理、环境保护、失地农民补偿等工作中发现的问题，逐一下发《监察建议书》，逐一进行问题整改，逐一完善监督机制，保质保量的完成了工作任务，并将多项工作纳入了执法监察的长效监管范围。

四是善于发现问题，着力解决问题，确保监察建议效果。

在执法监察工作中我们充分发挥监察建议主动、灵活、适合用广泛等特点，从源头问题入手，不忽略任何线索，不回避普通问题，力求切实巩固监察建议效果，从根本上解决问题，克服矛盾。2001年，我们在开展维护企业权益专项检查中，发现胜芳镇劳动服务站对企业违规收取劳动用工年审收费且使用白条收据。当时胜芳镇有企业20__-__家，而劳动服务站受镇政府与市劳动局双重管理，问题较为复杂。我们对有关情况做了进一步调查并将情况及时向纪委领导进行汇报，经批示后，对该所收费问题进行了立案调查。一举查出该所违规收费3__-__万元，同时纠查出市劳动局监察大队私设小金库，公-款送礼等问题，并对有关责任人进行了党政纪处理。我们及时对胜芳镇、市劳动局下发《监察建议书》对有关问题解决提出明确整改方案。市劳动局与胜芳镇政府果断提出整改措施，撤销原胜芳劳动服务站，在胜芳镇建立劳动分局，由市局下派专人进行业务管理与服务。此举减轻了胜芳镇内企业的负担，对规范全镇劳动用工、农民工维权等问题起到了促进作用，保证了全镇经济建设发展与社会秩序的稳定。

二、对实施《执法监察建议书》工作的意见

执法监察建议立足于已发事件，着眼于对继发问题的预防，对有关单位进一步健全规章制度，加强监督管理，有着十分重要的现实意义。实践工作中，执法监察建议也存在一些问题和不足，建议在提高认识的基础上，切实加以规范和改进。
